Jeremy Miller is a Paralegal within Merchant &amp; Gould’s litigation department in Alexandria, VA. His main responsibilities include supporting the firm in establishing the ITC department and assisting our IP attorneys. With over 22 years of experience, Jeremy is a true asset to the Merchant &amp; Gould team.

Jeremy started his journey into law by working as a Litigation Paralegal and later a Litigation Case Manager for two other boutique IP firms.&nbsp;

Jeremy conducted legal research, provided support during patent infringement litigations, and oversaw those litigations through all phases of fact and expert discovery and trial. It was during this time that he also began supporting attorneys through ITC investigations, a specialized area of law focused on intellectual property and unfair competition disputes concerning imported products.

Jeremy found he enjoyed ITC work and the unique aspects of that practice area and has overseen many ITC Section 337 investigations from complaint filing to final determination.

Supporting Merchant &amp; Gould’s ITC Practice

As a member of the firm’s litigation paralegals team, Jeremy is focused on helping inventors and companies protect their IP rights from patent, trademark and copyright infringement. He will also support our attorneys through ITC section 337 and our ANDA district court litigations.

Jeremy’s various responsibilities include maintaining case files, scheduling depositions, putting together exhibits for depositions and trials, and conducting research on behalf of our attorneys. With Jeremy’s experience in ITC and patent litigation work, he’s able to blend into our workflow seamlessly. As a result, our firm can better serve our national and international clients.

Jeremy greatly enjoys doing whatever it takes to support Merchant &amp; Gould’s attorneys across all practice areas. He especially thrives in situations that require strong problem-solving skills. And in the legal industry, these situations occur often.

Whether supporting an attorney through a difficult ITC case or determining how to maneuver the changing legal landscape due to quarantine, he’s always up for a challenge. Jeremy meets the unexpected challenges involved in law head-on.

Jeremy received his Bachelor of Arts from Marietta College, where he graduated with Honors. Originally from Ohio, in his free time, Jeremy enjoys fishing in the District and back in his home state as well as playing pool.&nbsp;

Merchant &amp; Gould P.C., a national technology and trial law firm, is pleased to announce a crucial victory for our clients TYC Brother Co., Ltd. and Genera Corp. before the U.S. International Trade Commission (ITC). In a pair of investigations concerning design patents related to automotive lamps, the ITC found no violation of section 337 by TYC Brother and Genera based on Complainants Hyundai’s and Kia’s failure to satisfy the ITC’s domestic industry requirement.



Merchant and its co-counsel Holland Law LLP were retained to defend TYC Brother and Genera against twin complaints filed with the ITC by automotive manufacturers Hyundai and Kia. The complaints asserted a combined 41 design patents against TYC Brother and Genera’s replacement headlights and taillights and sought orders that would have stopped all imports and domestic sales of those products.



An early evidentiary hearing was ordered under the ITC&#8217;s early disposition pilot program to determine whether the complainants satisfied the ITC’s domestic industry requirement. These investigations are the only ones to date for which the pilot program has been used.



Merchant identified numerous flaws in the complainants’ domestic industry evidence and analysis and developed a comprehensive record supporting our clients&#8217; positions. Following the ALJ’s initial determination, Merchant obtained full review by the ITC and submitted extensive briefing.



After considerable deliberations, the ITC agreed with Merchant, concluding that the complainants failed to satisfy the domestic industry requirement as to all 41 asserted patents. As a result, the ITC terminated the investigations with findings of no violation by TYC Brother and Genera, enabling their accused lamps to remain available to U.S. consumers, securing their access to high-value replacement parts.
